The property rights and obligations to the extent of the value of the inheritance of a person are transmitted to another through the decedent's death. The Ombudsman's exercise of power must have been done in an arbitrary or despotic manner - which must be so patent and gross as to amount to an evasion of a positive duty or a virtual refusal to perform the duty enjoined or to act at all in contemplation of law - in order to exceptionally warrant judicial intervention.

Further, this Court has ruled that "it is not necessary that the person in charge of the defendant's regular place of business be specifically authorized to receive the SUMMONS.
