In this age of fake news and presidents who label the media "enemies of the people,” pursuing the truth can be dangerous. That's why Time honored journalists with its “Person of the Year” award. They’re calling the reporters who have risked their lives this past year — and in some cases lost their lives — while pursuing the truth, “The Guardians."

Time's People of the Year include Jamal Khashoggi, murdered in October 2018 inside the Saudi consulate in Istanbul; Kyaw Soe Oo and Wa Lone, two journalists working for Reuters in Myanmar who were jailed for covering the persecution of Rohingya Muslims by the country's military; the entire staff at the Capital Gazette, the local paper in Annapolis, Maryland attacked by a gunman last June; and Maria Ressa — founder of the investigative Rappler Media in the Philippines.

Ressa and Rappler have been covering extrajudicial killings in the country, part of President Rodrigo Duterte's so-called war on drugs.

They've also been documenting how Duterte has weaponized social media to go after and silence journalists and critics. More recently, Ressa and her company have been targeted with tax evasion charges by the Filipino government — charges Ressa firmly denies.

The World has spoken with Ressa before and on Tuesday she joined host Marco Werman again to talk about what's happening in the Philippines.

Marco Werman: We've been talking about you a lot on the show lately. What is your reaction to being part of Time's People of the Year?

Maria Ressa: I had to look at it. Khashoggi's brutal murder done with impunity; the Reuters journalists Wa Lone and Kyaw Soe are still in prison for a year now; just this morning I posted bail for four more tax evasion charges; and what's happening in the United States now, the Capital Gazette. We're at this existential moment and the award recognizes that now is the time we need to mark this moment because we're going to battle and the challenges are very real, they have very real costs and our democracies are challenged — and the first line of defense is the journalists.

Just remind us what you've been working on as a journalist in the Philippines and why it's such a risk.

We started Rappler, a startup that began in 2012, and we know the best of social media because we grew exponentially — we live online. We're an investigative outfit that used the technology to build communities of action. But something changed at the end of 2015, the beginning of 2016. With the election of President Duterte in May of 2016, by July, when he began the drug war, we noticed that anger and hate were being used to stifle alternative narratives. Anytime anyone questioned extrajudicial killings, they were brutally slammed on social media — and Facebook is our internet in this country — to a point that it created a spiral of silence. So this kind of impunity that threatened violence happened in July of 2016.

By August, we brought the data to Facebook and then continued doing these exposés on the disinformation war, the propaganda war on social media. Today, the police claimed that they have killed 5,000 people in the drug war. But what they don't always add is that they're also investigating 30,000 other deaths. So, how many people have really died? And this level of impunity, how long can it be sustained? How long will Filipinos be OK with this?

Maria, you just mentioned posting bail on one of several tax evasion charges. When we spoke with you last, we were talking about those charges and you're going back to Manila to face them. What is the latest on those cases?

I've been indicted on five counts, five different cases of tax evasion stemming from one mother case that was filed against us in January this year that tried to take away our license to operate. We've done quite well [because] that mother case has been remanded back to the regulatory agency. But yet, the tax agencies have gone ahead and I've been indicted in this and could face up to 10 years in prison. I'm going to face them because — I've run out of synonyms for the word ludicrous for these charges — the only way that they can call me a tax evader is by classifying Rappler as "dealer in securities." We are obviously not a stock brokerage house. We obviously don't deal in securities. I'm not a stockbroker. So, I always say, "bring it. I'll see these charges in court."

And do you believe these tax evasion charges are a way of slowing your work down and that of Rappler Media?

Yes, absolutely. We're small and this takes away both time and resources and money that I could be using to build a better tech platform. For example, I'm using to pay lawyers. But I guess that's part and parcel of being a journalist in the Philippines today. The best part is by targeting me personally, in a way, I feel unshackled. I have firsthand experience of how the law is being weaponized against perceived critics. I'm not a critic of the government. I call a spade a spade. I've been a journalist for more than 30 years and will continue to do my job. 

That's what these times are teaching me. I've never lived through something quite like this. It's made it clear to me that the values, the standards and ethics that we just have to — now, more than ever — hold the line.

How do you think being included in the Time's Person of the Year is going to affect your work in the Philippines?

I hope positively, but you never know. There's a saying in Indonesia: "you know that the nail that stands up, gets the hammer." That's the rough translation. It wasn't my choice to be targeted, we weren't the first to be targeted, but we were among the first not to duck.

In our country today, I talk about the three C's — the way government gets you to do what it wants you to do. And that is: corrupt, coerce or co-opt. And Rappler refuses to do any of that. We want to continue doing the story, we call a spade a spade because now when facts are debatable, we need to tell the stories and we continue to do that. And just by helping us shine the light ... that has certainly been our best defense.

It's a disparate group of journalists that you're part of. What do you see that you have in common with the group?

It's dangerous to be a journalist and we take those risks and we know that those risks are part and parcel of what our job demands today — and we walk in with our eyes wide open. The journalists in Myanmar have been imprisoned a year and they're facing the same things we are, which is, there was hatred that was fomented by the military. But we tell the stories. That's what we're supposed to do.

There are all these claims of fake news these days often from strongman leaders often used to discredit credible journalists. What hope do you have that the overall atmosphere in the world is going to change for reporters?

I think about this short, medium and long-term. In the short term, the group that has the power to change it almost immediately — this is if they take responsibility for it — are the American social media platforms that have allowed the lies to multiply and to be weaponized against journalists or perceived critics.

Unfortunately, it's authoritarian rulers that have learned to manipulate social media and weaponize social media against the truth. Facebook is the world's largest distributor of news. Will it take the responsibility that came with it, that human journalists used to do? Because if they don't, we can't agree on the facts. 

In the medium term, journalists are important. We need to stand up and continue doing what we do because it's a changed world. The technology, these exponential lies, the rise of populist strongman leaders, is partly the manipulation of the human psyche. We've always said, "information is power." From my experience in the Philippines, part of the reason that information has helped turn the world upside down is because of technology. Hopefully, the pendulum stabilizes. And the new gatekeepers have to drain the toxic sludge so that real dialogue can again begin.

I'm curious, how are Filipino media covering your Time's Person of the Year story?

I don't know yet, but I know that I've been getting a lot of a lot of congratulations. One of the things journalists globally are learning is that this is not something that can be separated by boundaries of the nation-state. The old ideas of competition, they should be thrown out. We need to work together because the worst of human nature has been encouraged by these populist leaders weaponizing social media and we need to come back to use the internet according to the values that will preserve our humanity — and that's part of what unites us.

2018: A year of twists and turns at the Supreme Court

MANILA -- For the Supreme Court (SC), 2018 has been a roller coaster year as it saw a shake-up in its leadership, new faces and decisions that shaped the country's recent history and future.

Two Chief Justices in less than a year

This year, President Rodrigo Duterte appointed two top magistrates of the High Court following a tumultuous upheaval over its decision last June on questions clouding the leadership of Maria Lourdes Sereno.

Meeting the press for the first time last November, Chief Justice Lucas Bersamin, the SC's 25th top magistrate, vowed to do his best to institute long-standing reforms in the judiciary even as his term will last for only a year. He will reach the mandatory retirement age next year days apart on the same month as Senior Associate Justice Antonio Carpio.

Bersamin, in his public appearances, has echoed calls for dedication in public service by those in the judiciary and urged subordinates to forgo even checking their social media accounts during office hours which he insists are minutes in work which had been paid for by taxpayers.

Speaking at a recent event for children in conflict with the law, Bersamin consoled the minors who had run afoul with the law pointing out that rehabilitation and reform is a fresh chance and reminded them not to let it define the rest of their lives.

Bersamin is the most senior justice in the judiciary in terms of length of service, at the time of his appointment.

He succeeded another veteran, Chief Justice Teresita Leonardo-de Castro.

De Castro, who served as chief magistrate for less than two months, implemented key programs and projects.

These include increasing the monthly salary of first-level court judges all over the country; increasing the cost of living allowance for justices, judges and court personnel for the month of August chargeable to the 80 percent judiciary development fund (JDF) as well as additional grant of rice subsidy allowance for the first and second quarters of this year.

She also worked for the creation of technical working groups on planning, budgeting, data reconciliation and evidence management system. De Castro was an associate justice at the high court for 10 years and eight months prior to her appointment as top magistrate.

The Sereno debacle and new faces

The appointment of Chief Justice de Castro brought to a somber conclusion one of the dramatic turn of events in the high court's history involving its Chief Justice.

What would have been an 18-year term from her appointment by President Benigno Aquino III abruptly ended for Sereno after the Court en banc on May 11, 2018, voted 8-6 , to grant a the petition for quo warranto filed by the Office of the Solicitor General (OSG) to declare her appointment as void from the beginning for her failure to comply with the mandatory legal requirements for her appointment in 2012.

The Court also ruled Sereno was disqualified for the Chief Justice post when she failed to submit her Statements of Assets, Liabilities, and Net Worth (SALN) from 2002 to 2011.

This year, President Duterte appointed three new members of the SC following the retirement of Chief Justice De Castro, Associate Justice Presbitero Velasco Jr., and the appointment of Associate Justice Samuel Martires as Ombudsman.

These are Court of Appeals Associate Justices Jose Reyes Jr., Ramon Paul Hernando and Rosmari Carandang.

Big rulings

Earlier in December, the High Court ruled that government agencies can regulate the motorcycle transport-for-hire mobile phone application.

In a two-page order dated Dec. 5, the SC's Second Division ruled in favor of a petition filed by the Land Transportation Franchising and Regulatory Board (LTFRB) and the Department of Transportation (DOTr) seeking to stop the operations of Angkas run by DBDOYC Inc.

This reversed the Mandaluyong City Regional Trial Court's order dated Aug. 20, 2018 against the LTFRB and in favor of Angkas.

In October, the SC upheld the constitutionality of two laws -- Republic Act 10533 (K to 12 Law) and Republic Act 10157 (Kindergarten Education Act, which overhaul the country's basic education system and expanding basic education from 10 to 12 years. The SC denied the consolidated petitions questioning them.

RA 10157, or the Kindergarten Education Act insitutionalized kindergarten education, which is one year of preparatory education for children at least five years old, as part of basic education and is made mandatory and compulsory before entering Grade 1.

The law was passed in fulfillment of the country's commitments to improve education standards in the country during the 2000 World Education Forum in Dakar, Senegal, where 164 governments, including the Philippines, pledged "Education for All" goals.

Likewise, to adjust to international standards, the K to 12 Law was enacted. Prior to this, the Philippines, along with Djibouti and Angola, were the only countries in the world with a 10-year basic education system.

In November, the tribunal upheld the legality of the Commission on Higher Education (CHED) memorandum excluding Filipino, Panitikan, and Philippine Constitution among the core subjects in the general education curriculum in college.

It held that Section 6, Article XIV of the Constitution on the use of the Filipino language as medium of instruction is not “self-executory.”

The SC ruled that the assailed CHED memorandum does not violate any existing laws such as Republic Act 7104 or the Commission on the Filipino Language Act, RA No. 7356 or the Law Creating the National Commission for Culture and the Arts, and the Education Act of 1982.

In criminal law, the Court declared that the “good faith” doctrine it laid down in its previous ruling cannot be used as an absolute defense to escape criminal prosecution for graft.

The Court made the clarification in a ruling which affirmed the decision of the Sandiganbayan finding three officials of the Department of Public Works and Highways (DPWH) guilty of several counts of violation of Republic Act No. 3019 or the Anti-Graft and Corrupt Practices Act involving anomalous transactions for the implementation of the PHP615 million regional and provincial infrastructure projects for the Autonomous Region in Muslim Mindanao (ARMM).

The Court had ruled that its earlier ruling that heads of offices may, in good faith, rely to a certain extent on the acts of their subordinates "who prepare bids, purchase supplies, or enter into negotiations" does not exempt a public official to inquire more closely into transactions he processes when there are circumstances that should have prompted a closer look.

In a separate case this year, the SC also allowed the Quezon City government to implement an ordinance increasing the existing fair market values (FMVs) of land, buildings, and other structures in the city from 100 percent to as much as 500 percent.

The Supreme Court (SC) ruled that the petitioner in the case, the Alliance of Quezon City Homeowners' Association, Inc. (AQCHI) has not legal standing to file the suit.

In February, the High Court also upheld the legality of the extension of Martial Law in Mindanao until the end of 2018.

Voting 10-5, the SC dismissed the four petitions filed by congressmen led by Albay Rep. Edcel Lagman et al; another group led by Bayan Muna Rep. Carlos Zarate and Anakpawis Rep. Ariel Casilao, et al; former Commission on Human Rights chair Etta Rosales; and a group led by Christian Monsod, one of the framers of the Constitution seeking to declare the martial law extension in Mindanao as unconstitutional.

The Court pointed out that Congress had discretionary authority to formulate, adopt and promulgate its own rules.

It also rejected the argument of petitioners that the extension should have only been limited to 60 days, saying the Constitution did not fix a period of duration for such extension and was also actually silent as to how many times the Congress could extend martial law declaration by the President.

Even the alleged undue haste in granting the request for extension, according to the Court, cannot be a ground to nullify the extension

However, the SC noted that it can only intervene when there is a clear showing of such arbitrary and improvident use of the power such as would constitute a “denial of due process.”

The Court explained that it can only step in once there is clear showing of arbitrary and improvident use of such power by Congress under Article VII, Section 18 of the 1987 Constitution, which it said is lacking in this case. (PNA)

Record move in 2018: ‘Judicial divinity’ not impeachment ousted Sereno from SC

The ouster of Chief Justice Maria Lourdes Sereno has been expected but not in the manner it was done.

The impeachment trial has been ongoing in Congress since 2017.

The impeachment complaint was filed by Atty. Larry Gadon who alleged that Sereno failed to report or include in her SALN the earnings she made when she represented the Philippine International Airport Terminals Co. in the controversial case over the alleged irregularity in the construction of Terminal 3 of the Ninoy Aquino International Airport.

Sereno was also accused of purchasing a brand-new 2017 Toyota Land Cruiser worth P5.1 million using public funds.

More than 20 lawmakers endorsed Gadon’s complaint.

The former chief justice attributed the attack against her to her statements against President Rodrigo Duterte.

How did the clash start?

Sereno and Duterte have been at odds since 2016 when she sent the President a letter telling him that disclosing the names on his drug list that included judges were premature.

Duterte gave Sereno some tongue lashing for allegedly interfering with his job and even threatened to declare martial law. The President eventually apologized for his harsh words.

Again, the clash between the two leaders ignited with the high court’s decision to allow the burial of former President Ferdinand Marcos at the Libingan ng mga Bayani.

Sereno, in her strongly worded dissent, said she could not allow “such an expedient and shortsighted view of Philippine history.”

Then, after Duterte declared martial law in Mindanao because of the Marawi siege, Sereno, in a speech said “martial law power is an immense power that can be used for good, to solve defined emergencies; but all earthly powers when abused can result in oppression.”

Impeachment complaint

With the filing of the impeachment complaint, in late 2017, the Palace called on Sereno to resign and spare the judiciary from “further damage” to which the then Chief Justice shrugged off.

Sereno was defiant and continued with her tirades against the administration, issuing statements against extra-judicial killings, human rights violations and eventually calling for Duterte’s resignation.

She also stood pat in her decision not to appear in Congress to answer the allegations against her.

This, however, did not sit well with officers and members of the judiciary who staged a “Red Monday” protest and called for her resignation. The judiciary’s action was in contrast when the late Chief Justice Renato Corona was facing an impeachment trial, his colleagues, as well as the other officers and employees, rallied behind him in a “Black Friday” protest.

Was it two weeks or indefinite leave to prepare for impeachment battle?

On February 27, 2018, Sereno took an indefinite leave of absence. Her letter, which initially confused even among her colleagues, made it appear that she took a leave voluntarily.

However, high court sources said her hand was forced by her colleagues who confronted her during the Feb. 27, 2018 en banc (full court) session for her non-compliance with the requirements when she applied for the Chief Justice post.

Quo warranto proceedings

Five days after she took an indefinite leave of absence and with Sereno’s continued defiance to appear in Congress, Solicitor General Jose Calida sought the “divine intervention” from the “God of Padre Faura by filing the quo warranto petition.

Quo warranto proceeding is filed to remove an officer who is not qualified for the position he or she has been occupying for at least a year. However, Calida’s petition was next to impossible because a chief justice can only be removed in an impeachment proceeding.

Two months after the quo warranto petition was filed, Sereno became the second chief justice to be ousted from office but the first to be ousted via a non-constitutionally mandated method.

The high court, in its ruling, said Sereno could be removed via quo warranto proceedings since it was “separate and distinct from impeachment.”

The majority vote was composed of Associate Justices De Castro, Diosdado Peralta, Lucas Bersamin, Francis Jardeleza, Noel Tijam, Samuel Martires, Andres Reyes Jr. and Alexander Gesmundo. Those who dissented were then acting Chief Justice Antonio Carpio and Associate Justices Presbitero Velasco Jr., Mariano del Castillo, Estela Bernabe, Marvic Leonen and Alfredo Benjamin Caguioa.

The high court also ordered that an administrative case be filed against the former magistrate for violating the Code of Professional Responsibility and Code of Judicial Conduct “for transgressing the sub judice rule and for casting aspersions and ill motives to the members of the Supreme Court.”

Moving on

President Rodrigo Duterte appointed the second most senior magistrate to take over the Chief Justice portfolio.

The judiciary lauded Teresita Leonardo-de Castro’s appointment and celebrating with her were her colleagues.

“I think we should all move on for the good of the judiciary. Let us put the past behind us, but of course, we should not forget the lessons that we learned in that event in the history of the judiciary,” de Castro said.

Under De Castro’s watch, the high court has implemented several policies and reforms including the increase of monthly salary of first-level court judges all over the country.

She has also convened the Justice Sector Coordinating Council (JSCC) after a three-year lull. During the meeting, the JSCC approved the launch of a second Justice Zone in Cebu City as well as the creation of technical working groups on planning, budgeting, data reconciliation, and evidence management system.

She also led the SC in approving the new rule for direct payment of legal fees through over-the-counter payment in Land Bank of the Philippines branches and the increase fees for mediators and stenographers.

The high court has also approved the construction of halls of justices for Tanay in Rizal and Cagayan De Oro City.

During her stint, the high court en banc also managed to expedite pending applications, appointments to key vacancies at the high court which has remained vacant for years.

The SC has named Davao City regional trial court Judge Leo Madrazo as deputy court administrator for Mindanao last Sept. 4. This position has been vacant for over one year or since July 2017.

The High Tribunal has also named lawyer Ma. Carina Cunanan as SC deputy clerk of court and chief administrative officer in appointment paper also released last Sept. 4. This position, on the other hand, had been vacant since December last year. The high court also appointed lawyer Librada Buena as new SC first division clerk of court in place of clerk of court Atty. Edgar Aricheta who was promoted Clerk of Court of the SC en banc following the retirement of Felipa Anama, who retired from the judiciary in early 2018.

Senior Associate Justice Antonio Carpio lauded de Castro for “restoring dignity and harmony in the Supreme Court.”

Turning past trials into a positive 2019

After de Castro, appointed Chief Justice is Lucas Bersamin, the third most senior justice at the Supreme Court but President Duterte considered the most senior for having been in the judiciary for more than 30 years.

Chief Justice Bersamin, who would retire on Oct. 18, 2019 said “it’s high time we went back to that image of the judiciary that is very respected, the judiciary that is conscious of its place in the society.”

He also encouraged the SC employees that they should strive to improve the High Court and make changes in their regulations and rules of court to speed up the decision of the cases.

In return, he promised to provide more benefits to the court employees. “So work with me. Do not love me, but work for me.”

Filipino develops ‘Uber of lawyers’

A Filipino lawyer, who pioneered virtual or e-lawyering in the Philippines, has recently launched a mobile app with video-chat features to link clients and lawyers.

LexMeet is a wordplay on the Latin word for ‘law’ and workplace verbatim for setting office meetings.

“Lexmeet is an online legal consultation platform where lawyers and clients meet to solve legal problems. It is also a marketplace for legal products and services,” says Valderama, who passed the Bar exam in 2001.

Valderama describes the LexMeet app as the Uber of lawyers, where clients can seek legal advice by a mere click.

“Instead of an Uber vehicle matching with the nearest rider, LexMeet is where client’s legal problem is matched with the lawyer’s expertise, location and language and we serve as a bridge for them to meet via video or call conference,” he says.

He says the mobile app provides a convenient means to access legal services at affordable cost.

“The traditional consultation is costly, while this is affordable. Starting with P500, you will be able to talk to a lawyer. Whereas in the traditional, consultation alone costs P2,000 to P3,000. It is also convenient. You don’t have to leave the comforts of your home. If you have Internet, you could talk to them via video conference or voice call inside LexMeet,” says Valderama.

LexMeet allows clients to register their personal details for free, and they can purchase credits for as low as P500 via Paypal, Dragonpay, Coins.ph and later on Google Pay payment gateways.

Clients can initiate a legal consultation request where LexMeet will match their legal problem with a lawyer specialist that meets their requirements.

Valderama says he launched LexMeet as an expansion of E-Lawyers Online which he introduced in 2010 and to provide other lawyers with online avenues to offer their legal services to more clients.

He says the LexMeet app employs a unique algorithm that helps clients choose the right lawyer for their specific legal problems. Clients are given a list of lawyers who have expertise in different fields. The lawyer’s location and dialect are also shown to clients to guide them in the selection process.

“LexMeet works as a communication platform as well as a matching platform. Clients sign up, register and load credits. After that, they submit their legal problems in advance and they would be able to select the lawyers,” he says.

“LexMeet does not only provide lawyers, but also matches with legal problems so that when a client has a legal problem in his property, he will be matched with a lawyer with specialization in property law,” says Valderama.

“For example, if a client has a problem with a condominium unit and he is a Cebuano, he could get a Cebuano lawyer specializing in property law and speaking in Cebuano,” he says.

The platform allows clients to request the date and time of the online legal consultation with the lawyer. Through LexMeet’s own video chat consultation platform, they could directly ask questions and make clarifications.

“If you want a legal document, you can also get it from LexMeet,” says Valderama, who served as an senior associate lawyer of Florentino & Esmaquel Law Office before establishing his online business.

He says the ultimate plan is to provide full legal services through LexMeet. “If you want to tap full services, you may meet them personally. But later on, we will have a product where all the services will be done inside LexMeet,” says Valderama.

LexMeet now has 7,500 clients and 250 lawyers. “We usually recruit lawyers through friends. It started with my friends, then friends of friends, but we asked them to submit a copy of their IBP ID. Then we check their identification with the Integrated Bar of the Philippines to ensure they are duly licensed,” says Valderama.

Valderama says LexMeet also protects clients’ personal and financial information by securing its app and website with Secure Socket Layer or SSL certificate.

LexMeet earns from its share in legal consultations. “Our business model is that we collect from the platform. Every time the client speaks to the lawyer, the lawyer earns, but we also earn per minute basis,” he says.

Clients’ credits are automatically paid to their matched lawyer after the meeting ends. Ratings and feedback mechanism help ensure that LexMeet’s crowdsourced network of 250 lawyers provide quality advice.

Valderama also expects LexMeet to be the online go-to-place for overseas Filipino workers and entrepreneurs.

“The Philippines has more than 10.23 million migrant workers scattered all over the world. With Filipino diaspora, there is a demand for legal services for the legal issues left behind by our migrant workers such as marriage, support and custody issues, inheritance, investments, among others. Also, we have so many SMEs, almost 1 million now, who are needing legal guidance from lawyers. The lack of online facility to help our OFWs and SMEs in solving their legal problems is our prime motivation in establishing a primary hub of e-lawyering, ” says Valderama.
